The following terms and conditions apply to your account with Southern Auto Finance Company, LLC (SAFCO). Use of the Website (www.GoSAFCO.com), registration for access to portions of the website, and/or use of the Application will be deemed your agreement to abide by these terms and conditions.
- Definitions
“Access Information” means any or all of the following information: your Account number, user name, password and any other security or access information to your Account.
“Account” means an active or inactive retail installment sales contract with SAFCO whether the account is solely in your name or if there are other persons on the same account with you.
“Account Holder” means any person(s) singularly or jointly responsible for the obligations on the Account.
“Online Services” means services offered by SAFCO through the Website, Application, or any future digital distribution platforms (such as a website or software program) or other forms of media not yet developed that are available to Account Holders.
“Vehicle Contract” means the retail installment sales contract that is associated with your Account.
“We,” “Us,” and “Our” refer to SAFCO, Our agents, employees, attorneys, affiliates, subsequent creditors, servicing companies, third party collectors, or any authorized assignee of the foregoing.
“You” and “User” shall refer to all individuals accessing the Website or any Online Services for any reason. Whenever “you” is more than one person with respect to any Account or relationship, the obligations and agreements applicable under these terms and conditions shall apply jointly and severally wherever appropriate. - Account Management

Communication Disclosure. You agree and consent to be contacted by SAFCO, Our agents, employees, attorneys, affiliates, subsequent creditors, servicing companies, and third-party collectors through the use of email, and/or telephone calls and/or SMS text messages to your cellular, home or work phone numbers, as well as any other phone number you have provided in conjunction with this account, including the use of automatic telephone dialing systems, auto-dialers, or an artificial or prerecorded voice (each, a “Communication”).

We may include your personal information in a Communication. You should take steps to safeguard your phone, email account, and your text messages if you want them to remain private.
While we will not charge you for a Communication, your service provider may do so. By using the Website or Online Services, you are expressly consenting to us contacting you on your mobile telephone number, or any other communication channel, without further notice. You also understand and agree that we may always communicate with you in any manner permissible by law. You agree that we may monitor or record any conversation or other communication with you.-
How to Update Your Records: It is your responsibility to provide us with true, accurate and complete e-mail address, contact, and other information related to this electronic consent and your Account, and to maintain and update promptly any changes in this information. We will not impose any fee to process the withdrawal of your consent to receive electronic Communications; however, your access and use of the Online Services may be limited and/or terminated. Any withdrawal of your consent to receive electronic Communications will be effective only after we have a reasonable period of time to process your withdrawal (typical response time to process these requests is three business days).

You understand the text messages we send may be seen by anyone with access to your phone. Accordingly, you should take steps to safeguard your phone and your text messages if you want them to remain private. No confidential information should be sent via text message.
Please notify us immediately if you change mobile numbers or plan to provide your phone to another person.
We may terminate our text message program at any time.

- Program Description:
- References. The references you provide to SAFCO may be used as credit references, or to obtain updated contact information for you.
- Third Party Authorization. You may authorize a third party to communicate with us on your behalf regarding account information. To authorize a third party, you must provide their first and last name as well as their date of birth for security purposes. Be advised that this authorized third party will be permitted to obtain any information regarding your account, including but not limited to, account status, payment amounts, and due dates. Be advised that authorized third parties are for communication with SAFCO only. Authorized third parties will not be submitted to any of the credit reporting agencies in conjunction with the Account.

- Delivery Preferences. Go green with SAFCO and have your statement sent electronically. Save time and ensure prompt delivery. - SAFCO Payment Options. SAFCO provides various payment methods, some of which may incur vendor fees. For specific information regarding particular methods of payment, please contact us at 800-599-8858, or visit our website at www.GoSAFCO.com/payments.
- AutoPay: Have your payment automatically withdrawn from your account on or before the due date with SAFCO’s free and convenient AutoPay service. Save the stamp and the hassle of remembering when your payment is due. Access your account online, then select AutoPay on the My Account Summary page to set up automatic payment arrangements using your debit or credit card, checking account or savings account.
- Online: Access your account online and select Make a Payment on the My Account Summary page. We accept VISA, MasterCard, Discover or Personal Checks. Subject to a $4.95 vendor fee.
- Over the phone: Call our office toll-free at 800-599-8858 and you may either use the automated payment system or speak with a representative. We accept VISA, MasterCard, Discover or personal checks. Subject to a $4.95 vendor fee.
- In person, with cash:
- PayNearMe: You may make your payment in person with cash using the PayNearMe service available at 7-Eleven, CVS, and Ace Cash Express stores nationwide. SAFCO customers can visit www.PayNearMe.com to enroll or contact us at 800-599-8858 for assistance. Vendor fees may apply.
- MoneyGram: You may make your payment in person with cash using the MoneyGram service available at Walmart stores nationwide. The company code is 1838 Ft Lauderdale. Vendor fees may apply.
- Western Union: You may make your payment in person with cash using the Western Union Quick Collect service available at various locations nationwide. Please visit www.WesternUnion.com for locations. The city code is SAFCO and the state is FL. Vendor fees may apply.
- Via Mail. You may mail your payment voucher along with your check, money order, or cashier’s check to the address printed on the voucher. Please allow 5 to 7 business days for standard mail to be received and posted to your account. Please review your due date to avoid any applicable late fees. Do not send cash through the mail.

- Online Payment Disclosures.
- Online bill payment is a service available to our Account Holders who register on the Website or for Online Services. Once registered, you may use online bill payment to authorize a one-time payment or schedule recurring monthly payments (AutoPay), on your Account. You acknowledge that the origination of electronic debit transactions from your bank account must comply with the current laws of the United States and the rules, as they may be changed from time to time, of the National Automated Clearinghouse Association. Payments will not be recurring unless you sign up for the AutoPay Program on the Website and receive confirmation from us.
- To set up AutoPay, or to make a change to your automated payment, log in to www.GoSAFCO.com and follow the AutoPay set up instructions. You must continue to make monthly payments on your Account until you have received confirmation of your enrollment. You can change or cancel your AutoPay setup online or by contacting us at 800-599-8858.
- Regardless of the payment amount or payment effective date you schedule using Online Payment, you are responsible for complying with all of the terms and conditions of your Account, including, without limitation, your agreement to make all payments when due and in the amount required by your Vehicle Contract. When using Online Payment, you should schedule your payments in amounts and with effective dates that will satisfy your payment obligations. If you do not make a payment when due and in the amount required, we will have the rights and remedies available under your Vehicle Contract or as otherwise available to us at law or in equity.
- Adequate funds must be available in the bank account where your payments are coming from when an Online Payment is processed. If a scheduled Online Payment fails due to insufficient funds for the full payment amount initiated, the Account will not receive credit for the payment and applicable fees may apply. You are responsible to make timely payments for the amount owed in accordance with the Vehicle Contract and these SAFCO Terms and Conditions.
- e. While SAFCO does not currently charge any monthly or payment transaction fee to use Online Payment, vendor fees may apply. Nothing herein relieves you of your responsibility to pay any amount, fee or charge you may owe us under your Account. You will be responsible for paying any amount you may owe other persons or companies related to the use of Online Payment or any bank account linked to Online Payment. For example, your bank may charge a fee in connection with electronic payments taken from your account with them for your Account with us.
- Failure to Effect Payment and Liability for Such Payments. If you attempt to make payments on your Account through the Website, Application, or through an authorized third party acting on your behalf we will use reasonable efforts to complete bill payments according to your instructions. However, neither SAFCO nor any third-party service provider acting on SAFCO’s behalf will be liable in any way (including, but not limited to, payment processing errors or fees) if:
- Through no fault of SAFCO or our authorized third party, you have insufficient funds or credit in your bank (or other financial institution) account to complete a payment transaction, or if your bank account has been closed;
- The bill payment feature is not working properly and you knew or were told about the malfunction before you started the transaction, or should have reasonably been able to tell that something was wrong;
- You do not provide SAFCO with complete, accurate, and current payment and contact information, or if you otherwise do not give complete, correct, and current information to properly complete the requested transaction;
- You do not authorize a bill payment in time for your payment to be made and credited to the account by the due date;
- Withdrawals from your account have been prohibited by an order from a court of proper jurisdiction for such things as a garnishment or other legal process;
- We or our authorized agent reasonably believe that a transaction may be unauthorized or fraudulent;
- Your computer, mobile phone, wireless service or any related equipment or software is, or was, not working properly;
- Circumstances beyond our, or our authorized third party’s control prevent completing an online bill payment including, but not limited to, telecommunication outages, postal strikes and other labor unrest, delays caused by fires, floods, and other natural disasters, terrorist acts or war.

- Online and Application Services
- Website. You may use the Website to learn about product and service offers that we may make available on the Website, to obtain Online Services that we may offer from time to time, and to create online access to your Account. You can use the Website to access your Account to obtain information about your Account, or to make payments on your Account.
- Informational Purposes Only. Content presented on the Website is presented solely for informational purposes and is not intended to create any fiduciary relationship between us. Nothing on the Website constitutes an offer to buy or sell vehicles or an offer of direct credit or lease. The terms of your purchase transaction are set by you and the dealership.
- Intellectual Property Rights. SAFCO retains all rights, title and interest in and to all intellectual property, including without limitation, the software and any modifications, updates, or derivatives thereto, as well as all copyrighted materials, common law and registered trademarks and service marks, trade dress of the Website and patented business processes, systems, or services. All rights not expressly granted to you in these terms and conditions are expressly reserved by SAFCO. You agree that any and all content, including but not limited to writings and images (collectively the “Content”), contained on the Website or any Online Service will strictly be used for your own purposes and you agree not to modify, disassemble, copy, download, transfer or otherwise provide the Content to any person or other entity.
You agree to be solely responsible for any damage resulting from your infringement of our intellectual property rights, or any other harm incurred by us as a direct or indirect result of your use of the Content or our intellectual property rights.
- Use of Application. The following requirements apply to your use of the Application:
- You will not use any electronic communication feature of the Application for any purpose that is unlawful, tortious, abusive, intrusive on another’s privacy, harassing, libelous, defamatory, embarrassing, obscene, threatening, or hateful.
- You will not use the Application to upload, post reproduce, or distribute any information, software, or other material protected by copyright or any other intellectual property right (as well as rights of publicity and privacy) without first obtaining the permission of SAFCO of such rights.
- You will not collect or store personal data about other users of the Application.
- You will not use the Application for any commercial purpose not expressly approved by SAFCO in writing. You will not use the Application to upload, post, email, or otherwise transmit any advertising or promotional materials, including without limitation, “junk mail,” “surveys,” “spam,” “chain letters,” “pyramid schemes,” or any other form of solicitation or unauthorized communication.
- You will not upload, post email, or otherwise transmit any material that contains viruses or any other computer code, files, or programs which might interrupt, limit, or interfere with the functionality of nay computer software or hardware or telecommunications equipment.
- You will not use the Application when you are driving a motor vehicle, even if doing so is legally permitted in your location.
- SAFCO does not charge for the Application, but your carrier’s data rates may apply to your use of the Application.
- SAFCO’s License to you: SAFCO grants you a single, non-exclusive, non-transferable and limited personal license to access and use the Application. This license is conditioned on your continued compliance with the terms and conditions of this Agreement. You may not rent, lease, lend, sell, transfer, redistribute, or sublicense the Application and, if you sell or otherwise transfer a device on which the Application is installed to a third party, you must remove the Application from such device before doing so. You may not copy, decompile, reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the Application, any updates, or any part thereof (except as and only to the extent that any foregoing restriction is prohibited by applicable law or to the extent as may be permitted by the licensing terms governing use of any open-sourced components included with the Application).
- Your License to SAFCO: Any communications or material of any kind that you email, post, or otherwise transmit to SAFCO using the Applicati9on, including data, questions, comments, or suggestions (your “Communication”) will become the property of SAFCO. You hereby grant a license to SAFCO to use any ideas, concepts, know-how, or techniques contained in your Communications for any purpose including, but not limited to, developing the marketing products using such information.
- Electronic Signatures: You agree to be bound by any affirmance, assent, or agreement you transmit to SAFCO using the Application, including but not limited to any consent you give to receive communications from SAFCO solely through electronic transmission. You agree that, when in the future you click on an “I agree,” “I consent” or other similarly worded “button” or entry field in the Application, your agreement or consent will be legally binding and enforceable and the legal equivalent of your handwritten signature.
- Security of Data Transmission and Storage: Electronic communications using the Application may not always be encrypted. You acknowledge that there is a risk that data, including email, electronic communications, and personal data, may be accessed by unauthorized third parties when communicated between you and SAFCO or between you and other parties. SAFCO and its affiliates, and agents are permitted, but not obligated, to review or retain your Communications. SAFCO may monitor your Communications to evaluate the quality of service you receive, your compliance with the Agreement, the security of the Application, or for other reasons. You agree that such monitoring activities will not entitle you to any cause of action or other right with respect to the manner in which SAFCO or its affiliates or agents monitor your Communications and enforces or fails to enforce the terms of the Agreement. In no event will SAFCO or any of its affiliates or agents be liable for any costs, damages, expenses, or any other liabilities incurred by you as a result of monitoring activities by SAFCO or its affiliates or agents.
- Miscellaneous: This Agreement constitutes the entire agreement between you and SAFCO regarding the Application, and governs your use of the Application, superseding any prior agreements between you and SAFCO regarding the Application. If any provision of this Agreement shall be held invalid under law, such invalidity shall not affect any other provision or provisions hereof which are otherwise valid. The failure of SAFCO to enforce any provision in this Agreement shall not constitute a waiver of such provision or any other provisions.
- Changes; Discontinuation; Termination of Online and/or Application Services. We may change or discontinue any feature of the Online Services at any time. A change may take the form of an addition, modification or deletion.
- Suspension or Termination of Online and/or Application Services. You agree not to use the Online and/or Application Services to: (a) engage in fraudulent activity; (b) violate any statute, regulation or other legal authority; (c) violate or attempt to violate the intellectual property rights provision in these terms and conditions; or (d) interfere with or obtain unauthorized access to our computer systems or software or those of any third party. In the event of an occurrence of any of the above or of any misconduct by you as determined in our sole discretion, we may terminate or suspend your access to any or all of the Online Services at any time without further notice. If you notify us that your Access Information has been accessed by someone without your authorization, we may suspend access to the Website, Application, or any of our Online Services until we can be sure that your Access Information has been secured.
- Your Account Information. To prevent unauthorized access to your account on the Website or through our Application or Online Services, you agree to keep your Access Information confidential and protected. You agree to take appropriate steps to avoid having your Access Information come into the possession of any unauthorized individual. You agree to contact us immediately if you believe that your Access Information has been used without your authorization. We will not be responsible for any loss you may suffer as a result of an authorized person using your Access Information without your permission or knowledge or beyond the scope of your authorization. You are solely responsible for your errors and negligence in using the Website or Online Services, including but not limited to input errors, negligent handling or sharing of passwords, or leaving your computer or any other device unattended while accessing your Account.
- Availability of the Website and Application. The Website, Application and the Online Services are currently available for your use 7 days a week, 24 hours a day. However, from time to time, SAFCO may perform maintenance upon or experience hardware, software or other technical problems related to the Website, Application, or our Online Services, resulting in interrupted service, delays, or errors. Under certain circumstances, SAFCO may deny your access to the Website, Application, or an Online Service or any part thereof, or the processing of transactions, in order to maintain or restore security or performance to the Website or our systems.
- No Representations or Warranties on Content.
- The Website, Application, and the Online Services and the content are being provided to you on an “as-is” basis. SAFCO does not make any representations, warranties or guarantees, express or implied, regarding the accuracy, correctness, or completeness of the content, nor the safety, reliability, title, merchantability, conformity or fitness or a particular purpose of the content.
- SAFCO makes no representation, warranty or guarantee that any content available for downloading from the website, Application, or through the use of our online services is free of infection from any viruses, worms, or similar code or computer programming routines that contain contaminating or destructive properties or that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information. Certain functions of our website may direct you to a third party. SAFCO is not responsible for any third party content or transactions.
- It is solely your responsibility to independently evaluate the accuracy or completeness of any opinions, advice, statements, services, offers or other information or content on the website and/or the online services.
- Indemnification.
You agree to indemnify and hold us and our agents, officers, employees and affiliates harmless from any and all claims, liabilities, damages, cost and expenses (including, reasonable attorneys’ fees and costs) (together, “Losses”) caused, directly or indirectly, by or arising, directly or indirectly, out of your use of the Website or any Online Services. When you agree to indemnify and hold another party harmless, you agree to protect, defend and pay for certain amounts. You will not be required to indemnify SAFCO or to hold us harmless for Losses caused solely by or arising out of the gross negligence or intentional wrongdoing of SAFCO, its agents, officers and employees. - Limitation of Liability.
